This was reported by the press service of the Specialized Anti-Corruption Prosecutor’s Office (SAP).
On October 9, 2023, during the preparatory hearing, the panel of judges at the HACC made a decision to close the “Rotterdam+” case based on paragraph 10 of part 1 of article 284 of the Criminal Procedure Code of Ukraine, which pertains to the expiration of the pre-trial investigation period defined by article 219 of this Code, after notifying the suspect.
It is noted that this decision was made with a separate opinion from one of the judges on the panel.
However, the prosecutor from the SAP disagrees with the court’s decision and will appeal it in the appellate court.
It’s worth recalling that on March 14, prosecutors from the SAP, based on the National Anti-Corruption Bureau’s (NABU) investigation, sent an indictment against six individuals involved in the introduction of the so-called “Rotterdam+” formula to court. According to the investigation, the introduction of this formula resulted in damages to electricity consumers amounting to 19.357 billion hryvnias during 2016-2017.
The prosecutor has also filed a civil lawsuit for the compensation of damages caused by the criminal offense to the state.
